For the first time since the FAA recognized the LAMA Airworthiness and QA Standards for light aircraft in 1985, the light aircraft community has come together to work for a common purpose...the creation of consensus standards and other documents for the design and quality of experimental and ready-to-fly light sport aircraft. Considering the individualistic nature of the light aircraft community, it is a remarkable achievement, only exceeded by the FAA creation of the common sense Sport Pilot rule. The Experimental Aircraft Association (EAA), has been the lead organization responsible for the bringing together of the light aircraft community, assisted by LAMA and other Associations. The ASTM has been a key supportive organization, providing the framework and guidance for the creation of the consensus and other documents, and thru their organizational skills, creating the forums to further consolidate the efforts of the light aircraft community. Q1: The FAA is very knowledgeable of the efforts of the EAA, ASTM, LAMA and others regarding Sport Pilot, and thanks them for their contributions. Be assured that the FAA will not disappoint the light aircraft community, and is working very hard, at the highest priority, to attempt to release the Sport Pilot Rule by Oshkosh. Q2: To make sure there is an immediate start under Sport Pilot, the FAA is concentrating first on a core group of Designated Pilot Examiners (DPE) and Designated Airworthiness Representatives (DAR) to assure the existing ultralight instructors and 2-place trainer fleet can operate under Sport Pilot. Note that there will be a 3-7 year transition period in which the ultralight trainer exemption will still be in effect, and those that wish to remain in that area can do so. Mike Gallagher noted that he would send Scott Sedgwick to reside at Washington, DC, if necessary to expedite the rule thru the DOT and OMB. The FAA is very serious indeed about LSA. The FAA recognizes LSA as the potential rejuvenator of light General Aviation. The comment was made that LSA is the "...biggest thing since the first flight by the Wright Brothers..." Q2: Using a valid state driver's license in lieu of a 3d class or other medical certificate is still in the LSA rule. Q3: LSA status and other activities related to LSA can be found on the EAA Sport Pilot website, and the FAA website. Q4: Pilots holding a private pilot certificate will be qualified to fly LSA without obtaining a LSA Pilot's license, but will require an LSA CFI or GA CFI log book endorsement before operating a LSA aircraft. It is not a restriction on GA pilots, but a rational safety feature. LSA aircraft do handle differently that GA aircraft, and accelerate faster upon takeoff, for example. It would be prudent for a GA pilot to check out in any aircraft not flown before. LSA aircraft rental, and insurance validity will probably require this anyway. Q5: Powered Parachute ASTM Consensus Standards are in final stages of approval within the ASTM. Fixed-wing Airplane Consensus Standards are in final balloting. Q6: Part l03 ultralights will remain as it is, except in 3-7 years, training in only special certificated LSA two-place aircraft will be allowed. Q7: A student private pilot's time is also valid for counting for LSA training time. Q8: Any logged time in any aircraft that meets LSA performance and weight requirements will be counted towards a LSA pilot's license. Q9: Existing ultralight 2-place aircraft can be placed under LSA Experimental category, and the owner of the aircraft can continue to maintain the aircraft, but to do the annual required under LSA, the owner must take and pass a 16 hour LSA course for inspection and maintenance. To get a Experimental certificate, the aircraft must be inspected by a DAR. Q10: Only the owner of the aircraft can do the necessary maintenance and annual as per Q9. Passing the 16 hour test does not qualify one to maintain and inspect someone else's LSA aircraft. You must first take and pass an 80 hours Repairman test before you are qualified to work on any LSA aircraft. Q11: Regarding existing GA aircraft certified to some standard already, the aircraft cannot be re-certificated under LSA, and must be maintained and annualed per usual by a certified A&P. However, existing GA aircraft meeting the LSA weight and performance requirements can be operated by a LSA ticketed pilot. Q12: The next owner of an LSA experimental aircraft can also get an inspection and maintenance certification, having taken and passed the 16 hour test. Q13: Any pilot, having a logbook endorsement and valid state drivers license, can fly any aircraft meeting the LSA requirements. This same pilot, can also transition back to GA or ATP, if he has that license, upon passing the proper FAA required medical. Q14: A Cessna 150, for example, can be used to train a LSA pilot, as the time would count, but a logbook endorsement for operating a LSA would still be required. Due to different handling, would the time in a 150 really be useful? Training in the 150 would have to be done by a PP CFI. A LSA instructor cannot give instruction in an aircraft not certified under LSA. Q15: A GA pilot will not have to retake all the LSA flight training of 20 hours. A simple checkout by a LSA CFI is all that will be required for a logbook endorsement. B. Ron noted that the FAA is constrained from giving out any details of FAA position on the LSA rule, or discussion, or time-line under the rules of law in the preparation of a final rule. Ron also noted that he was not so constrained, and would be happy to tell anyone what he knew about the status of the rule, or other details. C. It was also noted that Congressional mandate for preparing rules requires that the LSA Rule, having been released as a Notice of Proposed Rulemaking (NPRM) in Feb 2002, must be released as a final rule by the end of Sep 2003. D. This does not mean that the rule becomes effective at the end of Sep 2003, but that it signals the start of the activities that are necessary to implement the rule. E. It is a huge job, and some of the things that need to be prepared are: For each of the 5 different categories of aircraft, the 4 ASTM Consensus Standards for: (a) Design and Performance, (b)Quality Assurance, (c)Production Acceptance Testing, and (d)Continuing Safety of Flight, more LSA ground and flight instructors, AC's to clarify various aspects of the rule, training for aircraft inspectors and maintenance persons, training and certification of FAA Designated Airworthiness Representatives (DAR), Practical Test Standards for Pilots, grandfathering in existing two-place aircraft, particularly the ultralight 2-place trainers, and so on. F. The American Society for Testing and Materials is versed in the creation of Consensus Standards, and is so recognized by the FAA and OMB. The ASTM was selected by the Light Sport Community to provide them guidance on the creation of the various Consensus Standards required by the FAA. l. STATUS: The rule is yet to be sent out of the FAA to it's next review point, the Dept. of Transportation (DOT). Following that, it is then sent to the Office of Management and Budget (OMB). As they each have 90 days for review, it is incumbent upon the FAA to prepare well the way for a smooth and expeditious review by both DOT and OMB. 2. HOPE: The FAA stated that they are planning for rule release by the time of the EAA Convention in Oshkosh in late Jul 2003. The FAA Administrator will be present, and desires very much to make the announcement of rule release at this time. The various implementation activity mentioned in E. above is also scheduled to be released in draft form by Oshkosh. The FAA hedged a little bit, by adding that if the rule is not yet released by Oshkosh, that the Administrator would be able to give some indication of why it is not ready, and perhaps a new schedule for release. 3. COMMENTS RECEIVED: Almost 5000 comments were received on the NPRM, and the FAA must take the time to carefully review each one. Some very good comments were received, such as strong arguments for increasing maximum take off gross to 1320lbs, and speed to 120kts. In addition, "repositionable" landing gear for amphibian aircraft is being looked upon favorably. 4. QUESTIONS: Q1: LSA basics: 39kts stall in landing, 115kts max. level flight speed with engine at max. rated continuous power, 1232lbs max. T.O. weight, fixed pitch prop, fixed landing gear, except for amphibians. Q1(a): The release of the final rule does not stop at the end of Sep 2003, nor is the process started all over again. It is atrictions. An accident is much more probably when the GA pilot flys an unfamiliar airplane without a check ride. The FAA considers the requirement for an endorsement for a 20 hour LSA pilot to be an added safety feature for a low time pilot. Q16: Time flown by ultralight pilots will also count towards a LSA certificate, provided the pilot has his time flown certified via affidavit by one of the recognized association with the current 2-place training exemption. Joining the ASC, EAA, or USUA is recommended. Q17: No turbine engines are allowed under LSA. The FAA intends LSA to be basic, simple, easy to fly aircraft without the complcations of a turbine engine. Q18: A list of aircraft that will meet the LSA requirements has been listed in the EAA website. EAA Aerocrafter also has listings of light aircraft with their performance details. Classic aircraft are also being looked at by the EAA. In addition, the Light Aircraft Manufacturers Association (LAMA) has a more recent list of aircraft meeting the LSA requirements. Q19: The existing categories of certification, Experimental Amateur Built (plans built or 51% factory kit rule), Standard Certified, Primary Category, and Part 103 Ultralights will continue. The 2 new categories will be: Special LSA Certified factory-built ready to fly useable for training and rental, and LSA Experimental certified, in kit form, with no limits on how much of the kit can be built by the factory, useable for training in by the owner only, and not useable for rental. Q20: It is expected that factory-built LSA Special Certificated aircraft, ready to fly, will sell for about the price of a SUV: In the $30-40,000 range. Q21: A LSA pilot need not, but should carry their log book with them, especially when attempting to rent. The LSA rental agency will want some proof that the pilot has an endorsement to operate that particular aircraft. Note that the rental agency will probably want the renter to take a familiarization ride with the agency's LSA CFI before renting anyway. It is expected that LSA aircraft will rent similar to the cost of auto rentals. Q22: If your doctor says you are not medically fit to operate your automobile, then you cannot operate a light sport aircraft. Q23: A ticketed GA CFI will be a LSA CFI automatically, but must also have a logbook endorsement by another qualified LSA CFI to train in that LSA aircraft. It just is good common sense to get some experience in the aircraft that you are instructing in. Q24: Aviation insurance underwriters are already involved, and attending meetings of the Light Sport Aviation Main ASTM Committee. Q25: Canadian and overseas aircraft certified under various standards in that country can submit their testing and QA and production acceptance testing documents to a USA FAA DAR for review and certification under the LSA rule. Presently, LSA pilots can operate LSA aircraft only in USA. Q26: FAA is working very diligently to create enough DPE (Designated Pilot Examiners) to meet the predicted influx of students and existing pilots into LSA. They note that there will a 3 year transition before the rule is totally effective, and plan to use that time to ramp up necessary DPE's. Q27: The FAA would not confirm a time, but it is expected that 30 to 120 days after release of the LSA rule in late summer or end of Sep 2003, certified and log-book endorsed LSA pilots with their LSA biennial will be able to operate under LSA with their valid driver's license used as medical. Q28: A biennial flight review (BFR) will be required for LSA pilots. Keep in mind that LSA are Day, VFR only aircraft, a basic stick and rudder aircraft, so the biennial should be quite simple. Q29: A LSA aircraft cannot be operated by a LSA pilot at night. As in experimental amateur-built, any LSA aircraft properly fitted with lighting and instrumentation, can be operated by a certified private pilot at night.
